Unwanted calls and texts in Alabama: what the rules say

Alabama has rules for some sales calls, including calls to numbers covered by the Do Not Call protections and requirements to identify the caller. Separate Public Service Commission rules govern automated and live solicitation calls.

Where the rules draw a line

The Alabama Public Service Commission says the state Do Not Call list is combined with the federal registry. Alabama's private action has narrow repeat-contact and knowing-violation requirements; it does not create a set payment for every unwanted call. The commission's administrative rule sets call hours, which are different from statutory damages rules.

What this can mean for a consumer

A consumer who received more than one call in 12 months from the same seller may have a claim for certain knowing Do Not Call or caller-identification violations. The statute allows an injunction and actual loss or up to $2,000 for each qualifying knowing violation, whichever is greater. The Alabama PSC's separate penalties are public enforcement. For a complaint, contact the PSC or Alabama Attorney General.

Keep the details

Save the full text thread, call log, voicemails, dates and times, the company or product named, and any reply asking the sender to stop. Those details can help show what happened; they do not establish by themselves that a law was violated.
