Unwanted calls and texts in Florida: what the rules say
Florida’s Telephone Solicitation Act covers sales calls, texts, voicemail, and certain automated or prerecorded communications. For a text-based private claim, the law includes a specific step: after an opt-out request, the texts must continue for 15 days before an action may be brought.
Where the rules draw a line
The statute provides a state subscriber list coordinated with the federal registry. Consent, prior opt-out, timing, and listed exceptions can change whether a communication is covered.
What this can mean for a consumer
An aggrieved person may seek an injunction or actual damages/$500, whichever is greater; a court may increase damages for a willful or knowing violation. Florida agency penalties are separate from consumer damages.
Keep the details
Save the full text thread, call log, voicemails, dates and times, the company or product named, and any reply asking the sender to stop. Those details can help show what happened; they do not establish by themselves that a law was violated.
