Unwanted calls and texts in Montana: what the rules say
Montana’s telephone-solicitation law is focused on voice calls and includes rules for numbers on the state Do Not Call list. The statute reviewed does not expressly extend those provisions to text messages.
Where the rules draw a line
The Department of Justice operates the list, which includes Montana numbers from the national registry. A private action requires repeated solicitations by or for the same seller within 12 months.
What this can mean for a consumer
A residential subscriber who meets the law’s conditions may seek an injunction and actual loss or up to $5,000 for a knowing violation, whichever is greater. Government penalties are separate.
Keep the details
Save the full text thread, call log, voicemails, dates and times, the company or product named, and any reply asking the sender to stop. Those details can help show what happened; they do not establish by themselves that a law was violated.
