Unwanted calls and texts in North Dakota: what the rules say

North Dakota restricts certain automated or prerecorded voice calls, including sales calls to numbers on the Do Not Call list. Covered automated solicitations generally must stay between 8 a.m. and 9 p.m. at the recipient's location.

Where the rules draw a line

The chapter expressly regulates prerecorded and synthesized voice calls. Although its private-enforcement section uses the word “message,” the chapter does not clearly define that term to include every SMS text, so this summary does not claim state text-message coverage.

What this can mean for a consumer

A person who receives a solicitation or message that violates the chapter may seek an injunction and damages under the statute; the possible amount depends on the actual violation and the court. The Attorney General may separately seek civil penalties of up to $2,000 per violation. Caller-ID fraud has a separate provision and prerequisites.

Keep the details

Save the full text thread, call log, voicemails, dates and times, the company or product named, and any reply asking the sender to stop. Those details can help show what happened; they do not establish by themselves that a law was violated.
